28.  All the products sold on hsbfragrances.com are governed by different state laws and if hsbfragrances.com is unable to deliver such products due to implications of different state laws, hsbfragrances.com will return or will give credit for the amount received by hsbfragrances.com from the sale of such product that could not be delivered to you barring the shipping charges. You will be required to enter a valid phone number, email and address while placing an order on hsbfragrances.com. By registering your phone number with us, you consent to be contacted by hsbfragrances.com via phone calls and / or SMS notifications, in case of any order or shipment or delivery related updates.
    
29.  While availing any of the payment method/s offered at hsbfragrances.com, hsbfragrances.com will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to you.
30.  All payments made against the purchases/services on hsbfragrances.com by you shall be compulsorily in Indian Rupees. We can arrange delivery of goods in Indian Territory only & subject to availability of courier services in that geographical area.
31.  Shipping: We strive to deliver products purchased from hsbfragrances.com in excellent condition and in the fastest time possible. Delivery charges at actual are charged. With every order, you will receive an email containing the details of the order placed by you. Once we ship the item(s), you will receive another email containing the shipping details.
32.  Delivery: We process all deliveries through reputed couriers. If there is no courier service available in your area, we will communicate you in this regard & mutually decide the alternate means. We ship within 3 working days for deliveries in India. The estimated time of delivery may vary from 4-7 working days within Maharashtra. For rest of India, orders will take 1-2 weeks depending on the location. Business days exclude public holidays and Sundays. 
33.  Risk of loss: All items purchased from hsbfragrances.com are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

However, hsbfragrances.com does not warrant that product description or other content of this site are accurate, complete or error-free. Please read the usage/ warnings/ Do’s & Don’ts mentioned on Product Packing or literature attached. The Fragrant products manufactured are based on high quality ingredients. Though enormous efforts are made and precautions taken to render the products absolutely safe for human use, it is possible that certain ingredients may cause allergic reactions to certain individuals or adversely affect individuals with pre-existing medical conditions. Please make yourself aware of the ingredients and usage instructions accompanying each of our products to make sure that they are safe for you to use. It will be your sole responsibility to take proper precaution/ professional medical advice before using any of our products that you may be allergic to. You agree that the hsbfragrances.com will not be responsible or liable for any product related issues including any allergic reactions to you on account of usage of our products.
35. Pricing: Prices for products are described on our Website and are incorporated into these Terms by reference. All prices are in Indian rupees. Prices, products and Services may change at the discretion of hsbfragrances.com
36. 1. Replacement hsbfragrances.com offers you replacement of goods purchased on hsbfragrances.com. This means that you can ask for a replacement of the product/s subject to the following terms and conditions:
    1. You can ask for replacement of product/s in case of any Manufacturing defect found in the product and the same product/s will be shipped to you as a replacement for the defective product/s.
    2. Replacement is offered for the product/s sold by . hsbfragrances.com ONLY.

    Apart from condition reserved herein above, the following products shall not be eligible for return or replacement if:

    • Any product that exhibits physical damage to the box or to the product;
    • Any product that is returned without all original packaging and accessories, including the retail box, manuals, cables, and all other items originally included with the product at the time of delivery.

    Disclaimer: “Any decision n replacement on the product/s sold by hsbfragrances.com is at the sole discretion of  hsbfragrances.com and decision of hsbfragrances.com shall be final and binding. hsbfragrances.com reserves the right to withdraw from replacement guarantee at any time without giving any intimation of whatsoever nature.”

38.  Due to continuous improvements in product quality, the actual item/product may occasionally differ from that illustrated or specified. Not responsible for any omissions, typographical errors of descriptions and/or prices
39. Cancellation of order: hsbfragrances.com reserves the right to cancel any order without any explanation for doing so, under situation where hsbfragrances.com is not able to meet the requirement of the order placed or order so placed/cancelled does not comply with the hsbfragrances.com policy or for any other reason. However, hsbfragrances.com will ensure that any communication of cancellation of an order, so cancelled, is intimated within appropriate time to the concerned person and any applicable refund will be made in a reasonable time.
40. Cancellations by the Customer: In case we receive a cancellation notice and the order has not been shipped by us, we shall cancel the order and refund the entire amount. The orders that have already been shipped out by us will not be cancelled. The customer agrees not to dispute the decision made by hsbfragrances.com and accept hsbfragrances.com decision regarding the cancellation.

INDEMNITY

The User unilaterally agree to indemnify and hold harmless, without objection, the Company, its officers, directors, employees and agents from and against any claims, actions and/or demands and/or liabilities and/or losses and/or damages whatsoever arising from or resulting from their use of hsbfragrances.com or their breach of the terms.

LIABILITY

User further agrees that Company shall not be liable for any damages arising from interruption, suspension or termination of service, including but not limited to direct or/and indirect or/and incidental or/and special consequential or/and exemplary damages, whether such interruption or/and suspension or/and termination was justified or not, negligent or intentional, inadvertent or advertent.

User agrees that Company shall not be responsible or liable to user, or anyone, for the statements or conduct of any third party of the service. In sum, in no event shall Company’s total liability to the User for all damages or/and losses or/and causes of action exceed the amount paid by the User to Company, if any, that is related to the cause of action.

DISCLAIMER OF CONSEQUENTIAL DAMAGES

In no event shall Company or any parties, organizations or entities associated with the corporate brand name us or otherwise, mentioned at this Website be liable for any damages whatsoever (including, without limitations, incidental and consequential damages, lost profits, or damage to computer hardware or loss of data information or business interruption) resulting from the use or inability to use the Website and the Website material, whether based on warranty, contract, tort, or any other legal theory, and whether or not, such organization or entities were advised of the possibility of such damages.

Fraudulent /Declined Transactions

hsbfragrances.com reserves the right to recover the cost of goods, collection charges and lawyers fees from persons using the Site fraudulently. hsbfragrances.comreserves the right to initiate legal proceedings against such persons for fraudulent use of the Site and any other unlawful acts or acts or omissions in breach of these terms and conditions.

Applicable Law

This Agreement shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Kalyan, Maharashtra.
